Bong Tales is not liable for delays caused by third-party carriers or customs. Title and risk of loss pass to you once we transfer the products to the carrier.

SECTION 19 - FORCE MAJEURE Bong Tales shall not be liable for any failure or delay in the performance of its obligations under these Terms where such failure or delay results from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, fire, flood, epidemic or pandemic, strikes or labour disputes, riots, civil unrest, war, governmental action, changes in law or regulation, courier or logistics network disruptions, internet or telecommunications failures, or shortages of materials. Performance of affected obligations shall be suspended for the duration of such event, and estimated delivery timelines shall be extended accordingly. We will make reasonable efforts to notify you of any such event affecting your order.

SECTION 20 - DISPUTE RESOLUTION In the event of any dispute, controversy, or claim arising out of or relating to these Terms, the parties shall first attempt to resolve the matter amicably through good-faith negotiation, including by contacting our Grievance Officer as set out in Section 27. If the dispute is not resolved through good-faith negotiation within thirty (30) days of it being raised, either party may refer the dispute to mediation. If mediation is unsuccessful or is not agreed to by both parties, the dispute shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996 (as amended), by a sole arbitrator appointed by mutual agreement of the parties. The seat and venue of arbitration shall be Bengaluru, Karnataka, India, and the language of arbitration shall be English. Nothing in this Section shall prevent either party from seeking urgent interim or injunctive relief from a court of competent jurisdiction where necessary. This Section does not affect your rights, if any, to approach a consumer forum or authority under applicable Indian consumer protection law.

SECTION 21 - SEVERABILITY If any provision of these Terms is found to be unlawful or unenforceable, it shall be severed, and the remaining provisions shall remain in full force.

SECTION 22 - WAIVER; ENTIRE AGREEMENT Failure to enforce any right does not constitute a waiver. These Terms constitute the entire agreement between you and Bong Tales.

SECTION 23 - ASSIGNMENT You may not assign your rights under these Terms without our written consent. We may assign our rights at any time without notice.

SECTION 24 - GOVERNING LAW These Terms of Service shall be governed by and construed in accordance with the laws of India. Subject to Section 20 (Dispute Resolution), the courts at Bengaluru, Karnataka alone shall have exclusive jurisdiction to entertain any suit, action, or proceeding arising out of or in connection with these Terms, to the exclusion of all other courts. Nothing in this Section shall affect any statutory right you may have to approach a consumer forum or authority having jurisdiction over your place of residence or work under applicable Indian consumer protection law.

SECTION 25 - HEADINGS Headings are for convenience only and do not affect the interpretation of these Terms.

SECTION 26 - CHANGES TO TERMS OF SERVICE We reserve the right to update, change, or replace any part of these Terms by posting updates to our website. It is your responsibility to check periodically for changes. Your continued use of the Services constitutes acceptance of any changes.
